StatutoryDesk ("the Service") is an automated browser-based document formatting utility and mathematical calculator. StatutoryDesk is not a law firm, construction attorney, insurance brokerage, or certified public accounting firm, and does not engage in the practice of law. Use of the Service or downloading any statutory lien waiver, Affidavit of Nonpayment, Workers' Compensation pre-audit schedule, or OSHA Form 300A / ITA CSV file does not create an attorney-client or fiduciary relationship.
2. User Verification of Property Descriptions, Statutory Deadlines & Recording Rules
Mechanic's lien waivers and Affidavits of Nonpayment are strictly construed under state law (including O.C.G.A. § 44-14-366, Tex. Prop. Code § 53.284, Cal. Civ. Code §§ 8132-8138, and Fla. Stat. § 713.20). Users are solely responsible for verifying the accuracy of all legal property descriptions, owner and contractor legal names, payment through-dates, retainage exceptions, witness/notary execution requirements, and Superior Court / County Clerk recording deadlines with qualified construction counsel in the project jurisdiction prior to signing or recording any document.

THE SERVICE AND ALL GENERATED DOCUMENTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, STATUTORYDESK AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES, INCLUDING ANY FORFEITED MECHANIC'S LIEN OR PAYMENT BOND RIGHTS, UNPAID CONTRACT BALANCES, WORKERS' COMPENSATION AUDIT ASSESSMENTS, OR OSHA PENALTIES ARISING FROM USE OF THE SERVICE. IN ALL EVENTS, TOTAL CUMULATIVE LIABILITY SHALL NOT EXCEED THE GREATER OF $0.00 (FOR FREE USERS) OR THE SUBSCRIPTION FEES ACTUALLY PAID BY THE USER DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
